A new opportunity for taxpayers: the 2024 tax amnesty
A tax amnesty, regulated by Emergency Ordinance no. 107/2024
This autumn, entrepreneurs in Romania can use a new tax amnesty. It is regulated by Emergency Ordinance no. 107/2024, published in the Official Gazette no. 905 of 6 September 2024. The measure gives you the chance to pay off overdue budget debts and to have the penalties and other related charges cancelled.
What is the tax amnesty?
The tax amnesty is a cancellation of some debts or related charges (interest and penalties). It applies to main tax obligations that were overdue on 31 August 2024. This way, taxpayers, both individuals and legal entities, have the chance to clear their debts to the state budget on good terms.
Who can benefit from the amnesty?
The measure applies to:
- Individuals or legal entities (including companies and PFAs, authorised natural persons)
- Associations and other entities without legal personality
- Administrative-territorial units or public institutions
This amnesty is for those who had overdue budget debts on 31 August 2024.
What does the cancellation of penalties mean for companies?
For legal entities with overdue tax obligations, the tax amnesty cancels the interest, the penalties and the other related charges. The condition is that all main debts are paid by 25 November 2024.
Important note: Debts can be paid by actual payment, by offsetting or by other methods allowed by law.
How can you use the amnesty?
Taxpayers must file a notification with ANAF (the National Agency for Fiscal Administration) and make sure that all their tax returns are up to date. This is an essential condition for using this facility. After that, a request to cancel the related charges must be filed by 25 November 2024 at the latest.
What does the amnesty offer to individuals?
Individuals can have their tax debts cancelled, depending on the amount. For example, for debts below 5,000 RON, 50% of the main obligations are cancelled and all related charges are deleted, if half of the debt is paid by 25 November.
3% bonus for companies with no overdue debts
Another attractive measure is a 3% bonus on profit tax or on micro-enterprise tax. This reduction applies to taxpayers who pay their tax in full and have no other overdue tax obligations when they file their returns. The bonus applies to the 2024 fiscal year. It cannot be used for refunds, only to offset other tax debts.
Why is it important to act now?
This tax amnesty is a limited opportunity. It offers a simple and effective solution for taxpayers who want to settle their tax situation and optimise their business. It is important to meet the deadlines and to file the requests correctly, so that you do not lose this advantage.
